General Terms and Conditions determine the terms of purchase and sale of Deni Kragelj s.p.’s products. They are compiled in accordance with the Consumer Protection Act (ZVPot) and international codes for e-commerce. The deni.si online store is an information system intended for the presentation and sale of products to users.
1. ORDER
Orders can be placed on the https://www.deni.si website every day of the year, 24 hours a day. No registration is required. The buyer selects and orders the products available in the online store. When placing an order, the buyer is provided with an overview of the entire content of the order as well as information on the quantity and price in EUR. The website warns the user if he fails to fill in all the required fields. After agreeing with the general terms and conditions, the buyer successfully concludes a contract or order. The order can only be submitted when this confirmation has been made. After placing the order, the buyer receives an order confirmation to his email. The buyer can report any changes or cancellations of the order by responding to the received email. The changes will be accepted if they are submitted by the end of the working day when the order was placed. In the event that the buyer does not cancel his order on the same day, the contract for the purchase of products between the buyer and the seller is irrevocably concluded by the email “Confirmation of the order and shipment of goods” sent by the seller to the buyer. From that moment on, all prices and other conditions are fixed and apply to both the seller and the buyer. The buyer is a person with the information provided when placing the order. The sales contract is stored in electronic form on the seller’s server.
2. PRICES AND METHODS OF PAYMENT
All prices listed on the website are final and include all contributions and taxes. The discount for an individual item and the promotional code are also included in the final price. Special offers are valid until the last product has been sold or until the specified deadline. Enter the discount code in the shopping cart during the purchase process. As soon as you confirm the code, the price is reduced by a certain percentage of the discount. Delivery/postage costs differ when ordering within Slovenia or abroad, as the latter are charged additionally. The seller reserves the right to change the price. In this case, the buyer is informed in writing or orally and is offered the option to withdraw from the contract.
Method of payment by proforma invoice: After placing the order, we will send you a proforma invoice for the payment of the order. You pay the pro forma invoice via your online bank or a UPN form at the post office. After payment has been confirmed, we will send you the ordered products. The seller, Deni Kragelj s.p., issues an invoice on a durable medium. In the event that the payment for the product has not been made, the buyer agrees that the seller can send him a reminder, which shows the number of outstanding receivables, and a new UPN payment order.
3. DELIVERY OF GOODS
Packages are delivered via the Post of Slovenia. The cost of delivery for Slovenia is uniform and amounts to EUR 3.00. If the item is in stock, it will be delivered to your address within 10 working days at the latest. Usually, the item from the stock is sent the same day or the day after receiving the transfer. The delivery of the package can also be made to another address on providing the correct information. If the ordered goods are not in stock, we will notify you or the purchase will be disabled. We reserve the right to change the contractual partner for the delivery of shipments.
4. RIGHT TO WITHDRAW FROM THE PURCHASE AND THE RETURN OF GOODS
The buyer can exercise his rights arising from a material error if he notifies Deni Kragelj s.p. of this error within seven days from the day the book was delivered. In the error notification, the buyer has to notify the seller in writing to the email address terapevtskepravljice@gmail.com, describe the error, and allow for inspection. In the event the buyer wishes to return the item, he must send the package back by post to the address Deni Kragelj s.p., Smlednik 1c, 1216 Smlednik. The buyer is obliged to bear the costs incurred in returning the item of purchase. The original invoice, which the buyer receives with the delivered goods, must be attached. If the existence of a defect in the goods is not disputed, Deni Kragelj s.p. will grant the buyer’s request in accordance with Articles 37.c and 38. of the Consumer Protection Act within seven days at the latest. The purchase price will be returned to the buyer’s bank account as soon as possible, but no later than seven days after receiving the notice of withdrawal from the contract. We are not responsible for factual errors that may occur after the seven-day period from when the package was delivered.
5. PROTECTION OF PERSONAL DATA
We understand personal data to be any information that enables the identification of an individual. The term “personal data” has the same meaning as written in the GDPR, which is the EU’s General Data Protection Regulation. We store data for the purpose of communicating with you and for the purpose of providing a quality service. This includes all information related to the purchase: your name, surname, delivery address and payer’s address, email address and purchase details. If you do not trust us with this information, we will have to cancel your order and notify you in doing so. The basis for the storage and processing of data is a distance contract concluded at the time of purchase.
We will only retain your personal information until the purpose for which it was obtained has been fulfilled and for as long as it meets the legal, accounting and other reporting requirements to which we are committed. We will strive for the shortest possible data retention time. Data on orders must be kept for five years in accordance with the law. We do not store or process sensitive data. We also do not collect data on penalties and misdemeanours.
The buyer has the right to free information about all his data and also, if necessary, to the deletion of this data. Under no circumstances will the buyer’s data be passed on to unauthorized persons. If you have any questions regarding the deletion, processing or use of your data, please contact the seller via the provided email address.
Minors under the age of 18 may not place an order or provide any personal information without the permission of their guardians. The seller will not knowingly collect any personal data of persons he has been informed are underaged.
6. COMMUNICATING WITH THE BUYER
The seller will contact the buyer via means of distance communication, unless the buyer explicitly objects to this.
7. DISCLAIMER
The seller makes every effort to ensure that the information published on the website is up-to-date and correct. However, the characteristics of the items, delivery time or price may change before the information on the website has been updated. In this event, the seller will notify the buyer of the changes and allow him to withdraw from the order.
8. COMPLAINTS AND DISPUTES
The seller complies with applicable consumer protection laws. In the event of any problems, the buyer can submit a written complaint by email or to the seller’s address. The seller will acknowledge receipt of the complaint within seven working days, inform the buyer how long it will take to deal with the issue, and keep him informed of the progress of the procedure. The seller understands that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute. This is also the main reason for the buyer not to initiate a dispute in court. Therefore, the seller strives to resolve any disputes amicably. Otherwise, the court with territorial jurisdiction over the addressee’s domicile has jurisdiction to resolve the dispute. In the event that a disagreement does occur and the buyer is a EU citizen, the buyer can request an out-of-court settlement at the following link: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=EN.
In accordance with legal norms, Deni Kragelj s.p. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the buyer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
